Utah backs Montana’s challenge to gun regulation

Jul 17, 2010 –The Montana Shooting Sports Association, author of the first state law to exempt locally made and sold guns from federal regulation, is suing the U.S. Justice Department under the statute to force it to allow Montana manufacturers to work without federal licenses. The Justice Department in turn moved to dismiss the case, and U.S. District Judge Jerry Lynch heard that motion Thursday in Montana and took it under advisement.
This year the Utah Legislature joined Montana in passing a version of the law, and Utah Attorney General Mark Shurtleff filed a brief in support of Montana’s challenge. The challenge faces decades of established court precedents backing a constitutional role for Congress in regulating interstate commerce even down to local transactions that may have a ripple effect across state lines…States joining Utah in supporting Montana’s court challenge include Alabama, Idaho, South Carolina, South Dakota, West Virginia and Wyoming.
